Hi Dave,
Really sorry to hear you're not happy with MMC's decision.
We claimed for it in the normal fashion and it was rejected.
However, now that Morgan are back from holiday, we'll get it touch and try to swing their decision round.
I must say though that my experience with other manufacturers with regard to handbrake cables mirrors Morgan...it's seen as a "wear and tear" item.
We'll call you once we've spoken to our friends at the factory.
In the meantime keep saying nice things about us and we'll keep you on our Christmas card list!!
Chat later.
I'd agree with what Russell says. Because, in general, the replacement or not) of 'wear and tear' items is governed by the warranty rather than consumer law generally, the onus passes from the dealer to the manufacturer.
(I'm not a Scots lawyer but but my understanding is that the position is the same in Scotland as in England and Wales except for a slightly shorter period to claim)
All a dealer can do is bring his or her best offices to bear on the Factory using arguments such as image, customer goodwill, repeat custom etc and hope that works.
From the manufacturer's point of view, they will want to balance cost against happy customers and under 'cost' they will want not to set a precedent which might then bite them if there is later litigation by another customer over a similar item.
The only 'formal' way to establish a case here would be to find out if the same part has been replaced before in the same circumstances. That will be both very time consuming, difficult, always open to challenge and probably not viable vis -a -vis the cost of the item being complained of.
Needless to say, my comments above are just personal opinions
