Tim sore point with swmbo she took her Audi in to be sorted out and the mpg dropped . A London firm of solicitors are going to take them to court a bit like the USA did.

...Only marginally, VW manager Oliver Schmidt represented VW to the American environmental authority and lied to them.
He was so stupid or so naive as to spend his vacation in Florida with his family from Germany. That's why he's doing seven years in jail in the United States (and of course because he is guilty)

On the one hand, I think that's right for the Americans to send out a strong signal, but the really bad bosses of VW don't help him in any way. They are rather glad that Schmidt is the pawn sacrifice.

Yes, Oliver Schmidt joined the conspiracy late in the game and was less guilty than most of the ones who are still free. He was very naiive to try to leave the USA by plane -- anyone who watches American crime dramas knows that TSA has a computerized watch list of suspects under Federal investigation.

The judge was pretty tough to give him seven years, compared to the 40-month sentence for James Liang, the other VW executive in prison. Liang joined the conspiracy much earlier than Schmidt, but he was able to bargain for a reduced sentence by providing evidence to the investigation. Maybe Schmidt didn't have had much additional information to bargain with, or perhaps he thought it might be dishonorable to "rat" on his bosses.

On the bright side, this scandal has caused VW to rein in its obsession with Diesel and instead embrace electric motors in a major way. In the long run this will help VW, certainly in America. Last Friday I was at the DC Auto Show and went to the VW exhibit to see the prototype Electric Bus which was a big hit in California. Unfortunately the prototype skipped DC and is back in Germany, but it will probably be a hot seller in 2022.

As I understand it; their cars met the test requirements where they were required to do so under a specific test regime. Surely that’s what they were required to do.

As an analogy; does this mean that every child who received (say) private tutoring to in order to pass his/her exams will be called a cheat and removed from his/her school/university.

No. A better analogy would be that a child doesn't take the exam but instead gets someone to take the test for her/him. I would call that cheating. My daughter's VW is equipped with "cheat device" software which detects when it is being tested for emmissions and switches to a cleaner-but-sluggish mode. Once the car is back in the real world it switches back to the dirtier-but-lively mode.

I have been told that the EU regulations are vaguely written, but under American law "cheat devices" are specifically forbidden and the manufacturer's compliance papers include signed statements that no cheat devices were used. After the fraud was detected, VW got into deeper trouble with US law by trying to cover up the fraud at first, both by lying and by destroying evidence. But the ultimate red-handed evidence was the cheating software that is in every one of the 500,000 "clean diesel" cars.

As full disclosure my own +8 is both green and has zero emissions.

(It left the factory painted blue but I have since repainted it green, the MoT requirement for emissions is to emit ‘no visible smoke’ - it does not, hence de-facto ‘zero emission’).

I’ll put a flame suit on and allow you to tell me where i’m wrong.

The regulations also banned any devices that altered the running of the engine specifically during the test. Therefore clear criminal intent.

Having had the 'upgrade' on my Golf GTD, there is no difference in the feel of the performance. You just can't tell.

The only apparent change is how quickly the mpg builds on a journey. It seems to take a bit longer to tip over 50mpg on the display. Maybe that's also lying.
