I was involved in a crash yesterday.
Thankfully, I wasn't hurt, it wasn't the Morgan and, in fact, I wasn't in my car at all!
I'm struggling to make sense of it.
I was aggressively fingered (not like that) by an old woman and the mare that shunted her (not like that).
I got out of my car when the coast was apparently clear. By the time I was on the pavement, there was a bang.
The blame was given to me because I got out of my car, but:
a) the road was clear at the time;
b) how could I directly affect the incident if I was on the pavement at the time?

The car I was in is 14 feet long and 6 wide. From the time of closing my door, I would have briskly walked at least 10 feet before the collision.
That's 3 yards. To cover 3 yards at walking pace takes 3 seconds. So the incident happened 3 seconds after I closed the door.
I wonder, when attributing blame, should it have come to a police investigation, what temporal proximity must there be between two events to establish causality between them?
I will attach three sequential diagrams, though the third is inaccurate. I now remember stepping onto the pavement before the accident, as i turned around as soon as I heard the noise. [img][/img] [url=][/url]

Lexus man is your witness. Did you get his details?

Old woman should have waited behind Lexus.

She will probably try to blame you "for getting out", but Lexus man saw everything.

From the sketches above you did nothing wrong. The fault lies with the old woman for not waiting, and the Ford woman for not leaving enough braking distance. Taking your details is ridiculous.

As Dave says - nothing to do with you as the old woman should have stopped behind the Lexus and the old mare was too close. How can you be responsible when you had already not only started it competed your action of getting out of your car? Furthermore, if she thinks it is your fault and took your details and believes herself to be correct then she has committed an offence for not passing her details on to you, surely? Women's logic... somestick banghead
