I have driven the M3W in France, Belgium, Switzerland, Italy and Spain and not worn a helmet, not come across any problems with Police who always take an interest in the vehicle.
You may get away with it because the police don't know the law and/or you are on foreign plates. Other than the fine they can, and have, impounded quad bikes because the rider was not wearing a helmet.
Do you really want to take the risk of having your holiday ruined for something as silly as not wearing a helmet?
