Yes, there are position restrictions. For sure it has to be above the main brake lights but I'm not sure of the amount. It also has to be on the centre line of the vehicle.
It's not an item that is checked at the MOT in the UK.

Thinking about it, 60 cm (if that's right) must be for tin tops. I assume for soft tops it just needs to be the highest body point.

I need to correct what I said in my previous post. It seems that if fitted and wired then the light should work.
The manual states:
"Additional stop lamps
fitted and connected must
be tested. Where extra lamps are fitted and there is
doubt as to whether they are connected, the benefit
of this doubt should be given to the presenter."

The brake should be positioned to the centre line of the vehicle when possible. If, due toany obstruction or vehicle design, this is not possible, it should be positioned to the off side i.e.Driver’s side, of the centre line.

The height should be no less than 13.75” (350mm) and no more
than 59” (1500mm) from the ground or if the structure of the vehicle makes this impracticable 82.5” (2100mm).

I made them myself from a bit of ally bar. Hacksaw, file, drill, and tap. Nothing fancy.

Peter, thanks. What's the source? Is this UK specific or EU?

It is to me smile

At 600mm above the ground, it is to the law, too! smile

As mine is a 1986 car it didn't have a high level brake light as an original fitment.

The LED is higher than the main brake lights, and provides useful extra visibility when I'm braking.

I'm reasonably certain that there is no difference between EU and UK type approval regulations.....

The information came from a UK after market suppliers data sheet.(Ring Automotive)

TimH,
That's very neat, the bottom rung on your carrier is higher than mine with respect to the main stop lamps.

But if you can run to a roll bar then you can do this: I think Scruffymog has a similar solution.
