Well you wanted to know if the car can be registered in France and gets a COFC from factory in its EU4 -EU3 facelift format. I have the factory senior management and now 3 other dealers (French, German and Spanish) stating it in writing. I'm awaiting answers from another 20 dealers in western Europe - but so far it seems pretty clear.

If my painfully slow process of acquiring a new M3W can help other mainland europeans then at least my homework and investigation will have not been in vain.

I have been jumping through so many hoops now to get that car I should probably join the Circus. 23 more days to go !

Also one major point (that applies in France) - Morgans are registered as trikes and are not required to ANY KIND of MOT inspection. Without any inspection needed your EU3 pack is basically not "detected" since there's no detection in place. Now that doesn't mean our dear EU/Goverment is not going to step in soon to tax trikes/motorcycles and force MOT test. So that's a potential sword of Damocles for everyone. Again that's a problem for future us to deal with.

I would still think that in order to get your attestation in France you would have to declare it as something it is not (ie in compliance with French regulatory requirements, which follow the EU Regulation. If you admit that it has been modified, you may be required to produce something from MMC confirming that the vehicle is EU4-compliant and there may also be an inspection.

I would not expect a dealer to declare that a product it is selling is unofficial; and I would be surprised if any of them has taken legal advice on this. I am happy to stand corrected, but something about this does not look right.

I agree on everything stated above - all i'm saying is at the moment it manages to fall in between the cracks. From my own research it seems registering 3 Wheelers in some parts of the US happens because it sits in some kind legal grey area.

At this point in time the car is delivered with a certificate of conformity and is not required to pass any kind of inspection or test - EVER - I've contacted the MOT in France which is crystal clear on that point. There is no tests or any requirements for 2-3 wheeled vehicles with less than a 100bhp. All you need to do is submit your ID, proof of purchase, the original certificate of conformity delivered by the manufacturer or the dealer, proof of residence, proof that you paid your taxes on it and voila it is registered !

I know you don't trust the dealers and I respect that but they wouldn't be selling those EU3 packs if owners couldn't put them on the road and the fact that most sold new or used in the EU4 phase all come with the pack tells me its working at the moment. Again don't believe me go do your own research.

The problem WILL ARISE if and ever some kind of testing is required when selling the vehicle or if some MOT inspection is ever required then it that case you'll maybe (probably?) face issues when selling them or passing inspection. When that happens I'm sure MMC will provide a kit to retrofit it.

In other words most owners who have a facelifted EU4 in france today are able to register it on a loophole in the EU's legislation and control systems. That being said it seems that some countries have an MOT inspection for 2-3 wheeled vehicles and the EU3 pack isn't going through there.

Now will this change ? Maybe - this situation stands since 1992 and there's news every ten years about pushing emissions test and MOT inspections. With the relentless war on speed, green aspirations and empty government coffers I'm sure this last bastion of unregulated freedom will fall. Enjoy it while it last !

For me I can enjoy my EU4 face lifted in Dubai without any issues for the years to come and when I have to move back I'll see what the situation is then. So case closed - I've contacted pretty much everyone from dealer, inspection centers to government helplines.
