Despite some information to the contrary Italy requires a helmet in any 3 wheeler that does not have a roof or a safety cage. The roll bars of the M3W are not, repeat not, homologated as a safety cage so a helmet is required, even for visitors, in Italy.

Seatbelts if fitted must be used. For Italy it would have been possible to be homologated without seatbelts but since it was homologated with seatbelts they must be used.

To summarise:
Both seatbelts and helmets are obligatory in Italy. To not use them risks a fine and the possibility of having the M3W impounded.
