I just spotted a reference to this on Pistonheads, another twist in the tale: Bryan & Brewer "Give us our money back!"At the expense of innocent members of the public, Peter Brewer and his wife Mercedes have had it all, but their days in the jet-set may be coming to an end.
Solicitor Mercedes Travis took a car dealer to court over a £500k Bentley - a case which she won and then lost badly. So they're going to have to sell their home to pay for their vanity and scheming. Finally there is some justice but what about everyone else?

Unfortunately these types never seem to be served the justice that they deserve. Even if they declare bankruptcy to avoid paying back their victims they always seem to have wealthy "friends" who keep them in the luxury to which they feel they are entitled. Just why these so called friends should feel obliged to do so is never disclosed.
There are just too many of these sharks about and there are always people who can be convinced to part with their hard earned cash, particularly when big returns are offered.

For masochists like me who actually enjoy reading all the sort of stuff - the original judgement can be read in full here: Brewer v Mann & Ors (14-Oct-2010) and the full appeal hearing here: Brewer v Mann & Ors (07-Mar-2011) ... and good luck! To my mind, the most sensible comment on the whole affair is the very last paragraph of the appeal transcript... We would also express our regret, even if in so doing we are ignorant of everything there might be to know about the course of these proceedings, that the parties did not manage to settle their disputes without litigation, or at least prior to trial.
The sums at issue were not large, at any rate when once the car had been bought back by SMRL, something which Mr Mann had offered from an early stage.
In these circumstances it seems a shame that the parties could not have found for themselves a solution which sufficiently satisfied them all, so as to avoid much trouble, distress and risk. Litigation of this kind is or ought to be a matter of last resort.

Regardless of the rights and wrongs of the legal judgement in any particular case anyone spending that sort of money should have a certificate of originality in writing. At least then there is something to go by if it all goes wrong.
. Define "originality" in a 1930 car. Original might mean that the engine has never been taken apart and rebuilt - but how likely is that in a car of the age. Or that it has never had a body part remade after a bang. Or even that is has original tyres - I dont think any of us would expect that but you never know. If I were the seller of a car like that I would never ever give such a certificate since its a licence to claim.

Definition of originality..? Shades of eMog discussions past (-: In truth I suspect originality more often than not exists in the mind, more than anywhere else when there is a sale impending..? Estate agents love the term original, as in fixtures and fittings in Victorian and older houses..(-: Car sales love it too for it allows them to add a few bob to to the sale when the purchaser can be sold on the idea it is worth so much more as the result. Jeez even car enthusiasts are sold on it too when describing aspects of this that or the other ...? Original has been generally adopted as being worth more by in the mindset of the general public... So it must be worth MORE... (-: As seems to have been proven, the true identity of a machine is accepted relative to the numbers it wears and acceptance by the licencing authority of that identity. Beyond that, a traceable history aka provenance is perhaps a prerequisite if there are claims relative to a history that may be considered to add value, and perhaps more so if the added value is considerable....? When was the last time you checked the VIN or engine numbers on a car purchase...? I have only ever checked numbers once on a car, but did check both on every m/cycle purchase. Which is more important in the case of this machine, originality or identity, were it ever advertised for sale do you imagine the term original might ever be utilised....?
