I bet the legislation says something like....must meet standard x under test. So VW in court will say, it does! Nick Wont help. Judges in the US are political and operate to different standards for foreign companies. Look at the way they treated BP compared to the way they treated Exon for a similar offoence, except that in BPs case it was an American subcontractor who did the dirty and got away with it.

...true, and now you're getting me started on the Union Carbide disaster in Bhopal. At least 3800 people killed and 40000 disabled, and yet 31 years later the site has still not been cleared up, proper payment of compensation has not been paid and the guilty men have not been punished. If anybody deserves to be fined many billions it is Dow Chemicals (owners of Union Carbide). BP's and VW's misdemeanours are totally trivial in comparison. Shame on the USA for the obstructive way this case has been handled.

Just catching up with this...... The reality is that all the ECU's use similar algorithms and an awful lot of them from the same suppliers. It would not in the least surprise me that this was used by other manufacturers as well..particularly as many outsource the ECU calibration to said supplier. Manufacturers work to strict test achievement targets and the whole calibration is based around that. Indeed some major investment decisions are based upon the emissions test. Ford will admit that the reason they use iron blocks on the 1.0ltr Ecoboost is because it gives a quicker warm up than alloy. Start from cold being a key part of emissions testing. Tip of an iceberg possibly here.... More likely, IMHO, some USA based ECU supplier or manufacturer is niffed they did not discover it first and hence objected....

Only came across this today.
Am I alone in being neither surprised, nor particularly concerned?
All the so called emmissions tests, be they California, USA, EU or wherever are totally unrepresentative of real driving, which is why the published mpg figures are so meaningless.
The test cycles are political devices to allow the pliticans to claim they are doing something to improve air quality. I wouldn't be surprised if the real world figures for NOx fronm Eur 5 and Euro 6 diesel engines are far worse than the "test cycle". But there is no real, comparable data for the real world emissions.
VWs defence should be that as the testing procedures are meaningless they followed the lead of legislators and produced meaningless data.
