Why the DVLA have chosen to link the black and silver plate explaination in the same articles as the 40 year rolling tax exemption explanation is beyond me

No, it's the
same issue, as explained in the FBHVC newsletter reproduced above.
Black & Silver number plate eligibility has been linked to the historic taxation class for the last 14 years. It's only now that the rolling tax exemption has passed 1973 that the issue has come to light.
The key phrase in the DVLA response is
unintended consequence. I wouldn't be surprised to see the anomaly reversed at some point.
