It's hard to believe that a vehicle that's legal for sale in the USA isn't legal for sale in Maryland. What's the statute they're quoting here? You might be the only M3W in Maryland...lucky you, I have to deal with Michael down the road from me...but surely those 3 wheeled trikes are fairly common.
Why can't you register it as a motorcycle? That's what the MCO states, and that's the basis for it's being lawful for sale here.

Hey...there are guns for sale in Texas that you can't buy in Maryland, right? Guess it's the same logic. Weed is another example of States rights over Federal. I'm still waiting to see the letter Maryland sent to Morgan. Seems Maryland has it's own regs for motorcycles. supposedly, Texas is even worse. I "might" be able to register it as a "custom" motorcycle, but might" doesn't inspire me to write a huge check for what "might" wind up being a flower pot on my lawn.

I know this isn't relevant to your dilemma, but I live in St. Charles county Missouri and it's legal to sell fireworks in the county, but "illegal" to set them off in the county...
Go figure!

I have my 2015 registered in Texas as a motorcycle and one of my friends has a 2015 slingshot registered as well. no issues at all in Texas any longer.

That's great...
I know that several guys registered their M3W's in Texas over the past couple years, but when the Slingshots hit the streets, TX put a stop to them being registered.
I think that Polaris did some work with the legislature to get them through. If so, good for them.

This isn't a "States rights" issue. It's a commerce issue. You might want to first confirm with MMC that the M3W is Federalized for sale here in the USA, that it's recognized as legal for sale in the USA.
Then, you might want to get a copy of the regulation for registering a motorcycle, specifically, what their definition of one is.
If it is, then you have a case against Maryland for not honoring Federal statute. They cannot make this up as they go along, there needs to be some statutory basis for their denial to register it. You might be able to question the statute with regards to the M3W.
In any event, your dealer should be versed enough in this to have warned you before taking the order. He is the one who'd have to file the papers and get the license plate before delivering it to you. I suppose that's a different issue, though.

They are trying to resolve this, so at this point I'm trying to be patient. What's surprising to me is that MD sent their list of concerns over two years ago and there doesn't seem to have been any response from MMC at all. That's being explored right now. What really seems to be weird is that Maryland is claiming that they're denying it as a motorcycle due to NHTSA's regs, and not Maryland's. Gotta do some more research into that, like do NHTSA's regs say dual headlights need to be within 8" of each other?

States have the right to make sure it's actually NHTSA compliant when registering them. The "glazing" that it failed under IS about the windcreen. After reading the regs, my best guess (until I see the letter from Maryland to MMC...soon I hope) is that this is all about labeling. According to NHTSA the windscreen, tires, rims, brake hoses, etc. have to be LABELED showing they are DOT compliant. I'm guessing that's it because Maryland didnt spend much time with the M3W presented to them before failing it on "tires, brakes, headlights and glazing" and refusing to go any further in the examination. Anybody out there have the "proper" DOT labeling on your windscreen, tires, rims, brake hoses?

There was a recall for this issue of items not being properly labeled about a year ago, so MMC is aware of that issue and is to have rectified it on all new vehicles.
