I am now pretty much fully recovered but with some on going (permanent) nerve damage issues

my personal injury litigation settled in Sept 2018, 20 months after we initiated proceedings

the other side's insurers accepted liability and paid me substantial damages for pain and suffering, and potential loss of earnings

the accident was caused by a 26 year old Audi driver who was - by his own admission to the Police - talking on his phone hands free to his girlfriend, looking down on his sat nav and speeding

all of these distractions caused him to hit a Passat ahead of him

Audi came to stop in the middle lane, and Passat on the outside lane

it was pitch dark and no traffic around on the M40. as a result, I did not realise - as there were no other moving lights, I couldn't tell the lights were stationary - there were 2 stationary cars blocking 2 lanes until it was too late.

the Police didn't prosecute the Audi driver .. he was merely sent on a driver improvement course. when I spoke to Police and questioned this, they refused to comment. I suspect they might have prosecuted had I died.

the Audi driver tried to sue me for causing him whiplash .. when I pointed out to them that I never hit the Audi, he went back into the hole from which he crawled out

the public was amazing at the site .. 2 nurses came to help; as did others who helped to make sure that I was OK and to shoo away one person who was about to film me trapped in the car, covered in blood ..

it's good to close the story and be able to move on

I still have the spare wheel cover for the ARP4 as a momento. I also have the side screens mohair bag cover

I look back wistfully on my very short Morgan days of adventure.

but this is safer ..

Very shocking to read this out turn of the horrible incident , amazed the audi idiot wasn't prosecuted , I thought mobile phone usage while driving was at least a ban from driving .And then he has the audacity to try and claim for whiplash !!! You were lucky to come out of this alive . It doesn't matter how careful we are on any road there are always others who are totally selfish and dangerous in a car . Very glad to hear you are ok .

I didn't see this thread first time around and before I bought my Morgan.

Glad you're recovering from the accident and it is a salutary reminder that "classic" cars do not have the same safety margins as the more modern designs.

BTW, it is not currently illegal to use a mobile phone whilst driving if it is using a proper hands free kit.

Hi Sean. Good to hear that you are recovering and can hopefully put this horrendous accident behind you. I am sorry you were so cruelly robbed of your Morgan experience by that numbscull in the Audi.
I was very impressed with your colour choice for the ARP4 (beautiful!) and such a shame that it was written off.
Anyway, I hope you are getting lots of fun from the Merc.

Something I'm always aware of when driving Tarka, even with the airbag in the steering wheel.

The BMW and Mercedes have multiple airbags, crumple zones, exploding bonnet hinges so a pedestrian is swept up. over the roof and in the case of the MB autonomous braking.

But neither are as involving or rewarding as the Pus 8.

Thanks for the update Sean, and relieved to read you're on the up again. It does seem ludicrous regarding blameworthiness, but that's modern times although despite the 'systems' people can be so fantastic at such times still, thankfully.
