Yes K, I was thinking of challenging along those lines. It's all very well for them to say, as they did, "we may not be able to fix this", but that attitude costs us. Yours are good words, do you mind if I use them? smile

Brian. The garage has spoken, at great length for over 90 minutes, to Islands Insurance but regrettably, they are not being responsive with this matter. We shall just have to wait for the HPI "investigation" whatever that involves.

Thank you all for your concern for my parents. I have actually shielded all this from them, they just think I am trying to get the best price for their car. To be honest, my mother is just glad to get it off their drive so my father can't drive it anymore!

I don't have a lot of faith in HPI. I recently had to seize a stolen vehicle from an innocent purchaser who had bought it at auction with an HPI clear marker. When the poor chap approached HPI for redress their reply was sorry it hadn't appeared on the stolen vehicle list when we checked it so we are not paying out.
So basically their checks and guarantee are not worth the paper they are printed on.

A similar thing happened to be on my Morgan but was a Cat C rather than B. I didn’t a change of address and got my new V5 back only to find a CAT C Salvage Category listed, call the.DVLA turned out Lancaster (aka Markerstudy - worst insurance company in the world.) accidentally put a £2k insurance repair as a CAT C write off. Called Markestudy and they removed it and I got an updated V5 in the post. The DVLA should known who added to the salvage note as they would of notified the DVLA

We were warned that even if the insurance company still exists (by no means guaranteed), and after 12 years still has the records, they may be unwilling to help. We could be stuck with the car being an unsaleable write-off and I'd have to scrap it! banghead

The garage has been more than helpful. They accept that the car is genuine but with the system saying it's a CAT B write-off it's worthless to them. My parents' car has effectively been written off by red tape.

Has anyone else encountered a situation like this? The car salesman reckons in 22 years he hasn't! Any suggestions to resolve it gratefully received (I have advanced IT skills so hackery isn't out of the question!)

When I went to auction my Mercedes 300sl a couple of years ago I was informed that the car had been stolen in 1992. As I had the full history of the car I could see that the same owner had the car prior to and after the alleged theft. Also, all the MOT information backed up the history of the car. I had to get the insurance company that had put the car on the register to remove it; I only managed to do this through persistence, providing copies of the vehicle registration documents and bills of sale. Also, previous HPI checks did not flag any problems so when the problem was registered no one knows.

Aside to this another story .......

About 10 years ago we were rebuilding a house in the UK and were putting in double glazed windows and doors at great expense. I decided to get a loan as the the terms were very favourable. When a credit check was carried out it was deemed that I was a bad risk as I had defaulted on a previous loan when I owned and operated a crematorium (I kid you not). After the initial shock I started to do a bit of research and found that an individual or a company cannot own or run a crematorium by law in the UK. It still took a lot of nasty letters and emails to get it removed from my credit file.

That is one of the many reasons why I left the UK.

That is very interesting, as I know of two people that are ordinarily residents in France that purchased an M3W in one case and a Plus 4 in the other, both brand new but were forced to sell them as the French authorities refused to register them, sadly they both lost money over this heavy handed burocracy doh

Both were post Brexit so the cynic in me tells me they were just buggering around..

Yes, that has been my resolution. My buyer spent several hours over a 3 day period plugging away at Island Insurance with all the evidence and they eventually agreed to remove the entry. All credit to the garage, they were keen to have what is a very nice car and were prepared to put in the effort. I'm not sure if Island Insurance accepted their mistake or did the removal just to get rid of him but it is done.

HPI insist that only the company that added a record can remove it and as previously mentioned if they refuse - or worse, no longer exist - then there is nothing you can do. I hadn't had much dealing with HPI previously but my faith in the system now is low. A quick search on the internet has found many similar examples, most commonly with insurance companies adding records sometime after the vehicle has changed hands. Given the potential impact when mistakes are made I think the system needs some kind of official regulation.

Anyway, thanks to everyone for their input and I'm happy to report that the issue is resolved. My parents have their cash and are none the wiser about the problems!
