If the car is still in your name, and it wasn't ever actually sold to another person........ it's you car.....!!! π€·π»ββοΈ You had the SOR agreement with RTCC, that fact that Thorne's haven't sold it..... it must be returned......π€·π»ββοΈ You could have collected it at any time during the agreement. Where ever it is stored, it is your property it is not Richard Thorne's property and the nothing to do with the liquidators as it never belonged to RTCC..........!!!!!
Go and get it........!!!!! Accept NO BULLSHIT.....!!!!! Do not leave without the car.....!!!! IF.......... there's any crap to sort out after you've got your property back..... who cares..... you've got your property back........!
We had a similar issue last summer when were contacted by the liquidators to say a kitchen supplier we had bought a hell of a lot of expensive appliances from suddenly 'went bust'......!! After a bit of searching on the internet I found the owners home address. We jumped in the car and went to confront him..... (I'm large with a shaved head so can pull off 'menacing' when neededπ) It turned out he had all our appliances and had them stored in a unit on a farm some distance away..... we'll have them then.....!!!! We went straight to the unit, loaded up everything that was ours and left him to sort out the mess........

He sold my car in July, and still owes me money. Despite many phone calls and emails requesting a sales/commission agreement I never received one. I suspect many other people who placed cars with him to sell also had no formal written agreement.

Julian, Agree with you if V5 is still in his name, if not its an entirely different issue. If its still in his name and not at the premises the Liquidator has access too, then you have to report it stolen. to the Police and get them involved. Unless you know all the locations were the car maybe stored, its maybe difficult to track it down without their help. There could be all sorts of locations where it could be stored, not connected to his other businesses. Being interviewed by the Police tends to focus one's mind
Whilst it maybe on a sale or return contract, has any work or storage fee or whatever been raised and not paid on the car, creating a potential repairer's lien. A UK repairer's lien is a common law right allowing a garage or repairer to keep possession of a customer's vehicle (or other goods) until they've been paid for improvements or repairs made to that specific item, acting as security for the debt. It's a possessory lien, meaning the repairer must retain continuous possession, and only covers costs for work done on that specific item (not general debts). While it grants the right to retain the item, it doesn't automatically grant a right to sell it, though statute (like the Torts (Interference with Goods) Act 1977) provides a process for sale after proper notice.
In the liquidation that I was unfortunately involved in, someone started to take things into their own hands and finished up in serious trouble with the Police. when things turned somewhat nasty . But as they say each to their own.

One thing to note is that the V5 is a record of the vehicle KEEPER. The keeper is not necessarily the owner. If the car was sold then it is likely that DVLA would have been sent the details to change the keeper details to the new keeper. An invoice would show who it was sold to creating a new owner. It's this difference between keeper and owner that complicates it. They may be the same person or not. Hopefully the Administrators would have paperwork re the sale ( invoice) as part of the paper trail to the money. Getting the money means a pecking order is applied, HMRC being usually the first in the queue. Anyone else gets a share of any monies that can be recovered. It can get very complicated and take a long time. Anyone trying to recoup money or iyems would need to go via administrators with all proof for the claim. I seem to remember a couple of TM members having similar when Sifab closed as they sent items to him for work to be done. I don't know if they recovered any though.

For those interested in pursing any possible action see: The creditors meeting is convened as per the notice. It may be worth attending. ![[Linked Image]](https://i.postimg.cc/nMLdWGhy/The-Gazette-Richard-Thorne.jpg) Some points to consider may be has the vendor notified the liquidator of a possible retention of title? Has the director traded unlawfully and become personally liable for the debts of the company. There are plenty of historic references to Richard Thorne relating to various company insolvencies in the Gazette. Hope the OP can retrieve something from this sorry state of affairs.
