My view on helmets comes from an engrained risk assessment mentality working in Oil and Gas. If I am just tootling around at lower speeds on side roads I guess I take a risk by not wearing the helmet and it is not mandatory. No eye protection I would consider foolhardy, the eye is a sensitive piece of kit. If I am on fast A roads or motorway I like the helmet on. I wear a Caberg Riviera, it is so practical with aviator twin visors. Lovely on a cool morning and great when it rains.

Correct me if I'm mistaken (My wife does..) but the original question was about the legal position. Which is easily answered & has been.
If you're a student on a driving course, they will insist upon helmets from an insurance & communication perspective.
There may be confusion for future owners from a driving licence angle, but the car is classed as that - a car. Seatbelts are as mandatory as any other car use.
Eye protection is down to personal preference & isn't mandatory on one, two, three or more wheels. Recommended, but not compulsory. If you have eye protection fitted to a safety helmet it must conform to standards, but it's ok to wear Raybans if you so choose.
Please don't lets get into the usual "My mate would be dead if he'd worn a seat belt". There's an exception to every circumstance, but the laws are clear.

Martyn, What was that for? Long time ago, so I can't accurately recall, but I think it was for aeroscreens and no windscreen wipers. I often kept the 4/4 that way.

Yes but the November copy of Miscellany has an article on the experience, and I quoted directly from it. The communication and insurance issue is another matter entirely and to instruct - one has to communicate.

897 I don't think things are as straightforward as you suggest.
If the threewheeler is a car as you state, it would need to meet all the relevant construction and use legislation for cars .. air bags , 2 appropriately spaced rear lights etc etc.
In my registration document its a tricycle.

Well, this thread made me curious so I checked the portuguese legislation. Since all european legislations have become similar I suspect this solution must be the same as in many other european countries: Here goes, sorry but it's a google translation of the law:
1 - The driver and passengers in cars are required to wear seat belts and other safety devices with which vehicles are equipped.
2 – Separate regulations will set:
a) The exceptional conditions of exemption of the obligation of use of the devices mentioned in the previous number;
b) The method of use and technical characteristics of these devices.
3 - Drivers and passengers of mopeds, motorcycles with or without sidecar, trikes and quads must protect their heads by wearing officially approved helmet models, properly fitted and tightened.
4 - Provisions of the preceding paragraph do not apply to
drivers and passengers of enclosed vehicles or vehicles that have simultaneously a rigid protection structure and seat belts.
So ... as per #3, trikes are to be used with helmet. However, #4, I suspect worded to comprehend the BMW C1 bike, also applies to tricycles. And the M3W has both a rigid protection structure and seatbelts fitted (not sure if "enclosed vehicle" applies to the M3W but it becomes irrelevant because the other two conditions are met) Oh and definitely, according to portuguese law, the M3W is NOT a car, number of wheels dictate the category.

In my registration document its a tricycle. You make a fair point. It doesn't change the helmet/bicycle issue, but for everything else I'm open to offers then..
