Then it's a different matter that for historic reasons the three wheelers are seen as different vehicles in different countries, and in some they can't decide, it seems, at least with the helmet, as in the USA (or they change it quite a bit, to become one vehicle, such as in Australia, I think); and also that we see different demands in other areas, equipment, safety vests etc. The latter is perhaps the important one, together with the helmet.

Surely, with the all new driving license, if you are allowed to drive it, it shouldn't matter where within the EEA (apart from perhaps some differences for some classes, such as age), one would think? But yes, they did a change in January 2013; for example, a Swedish "B" (car license) from before that date covers all trikes from the age of 18; now it's from the age of 21 if more than 15 kW, and then only in Sweden. It is possible all these changes make it easier on an aggregated European level, but it was far easier some decades ago on the national level.

A good question, I think similar has been asked for specific countries, but then for trads. And I interpreted it as equipment etc. (even though the topic is "Helmet regulations ..." wink )

Dan, I believe Missouri's mandatory helmet law only applies to people under 21 years of age. You should look into HB 555 (2013) and SB 202 (2009), both of which should have provided an age exception for helmets.

As I understand it, the UK was compelled put this EU directive into law, same as any other EU country. There is nothing to stop a wider area doing the same, but that is their decision as far as I know.

As I understand it the derogation only exists because of Sweden, if they'd not held out for it, it wouldn't exist.

I should state my background on this issue. Until I tripped over the directive in August 2012, no-one in the UK had realised the implications. The MTWC was unaware, and initially the FBHVC responded to the effect it was a worry about nothing. Thankfully others in the MTWC saw the truth, but by then, the directive was a done deal.

The FBHVC now claim some credit here, but I'm seriously underimpressed by both their truthfulness and accuracy.

Despite some information to the contrary Italy requires a helmet in any 3 wheeler that does not have a roof or a safety cage. The roll bars of the M3W are not, repeat not, homologated as a safety cage so a helmet is required, even for visitors, in Italy.

Seatbelts if fitted must be used. For Italy it would have been possible to be homologated without seatbelts but since it was homologated with seatbelts they must be used.

This information comes from the official importer, Borghi.

To summarise:
Both seatbelts and helmets are obligatory in Italy. To not use them risks a fine and the possibility of having the M3W impounded.

PS. Don't complain! That is the law and that is the way it is. Be safe not sorry.

Dear Peter... i'm italian and i have a 3W
We did this conversation several times in the past and...according to Motorizzazione civile and Polizia stradale the italian situation is very particular.
The only similar vehicle is the Ape and the driver doesn't need to use the helmet because it doesn't have a open body but... it doesn't have any other crash structure homologated as a safety cage so...is the 3w an open body ?
Yes ...so use the helmet but...safety belts..another particular situation here

they told me ...art 172 cds it about : L6E, M1, N1, N2, N3 vehicle category

The 3W is homologated as L5E so ...the 172 art does not apply in this case
If you know which italian law made mandatory using the seat belts please tell me the number because you are right ...be safe not sorry but i want to respect the rule in anyway.
