I am not putting my two serious errors in writing, I will just say that I have never met a bad cop and so consider myself lucky. One was in my old Skyline and I consider myself very lucky to have got only the maximum fixed penalty notice that is legal considering the speed done. The other was really early in the morning and involved a tuned Volvo 850T5 and a police instructor/examiner/cadet, a camera riddled car and several alternative underwear configurations. The other four have been mobile radar over 10 years. These all got FPN and were from memory 36/30, 35/30, 46/40 and 83/70. If I ever manage to get my diary sorted and meet with you I will share the others. I share your views on part-time-plod often being more willing to write tickets based on my friends tickets. I also agree with the comment re "bolloxing" as the two serious meetings I had both resulted in a serious mental adjustment being performed but I consider myself to have been treated more than fairly. Sadly I am less mental and the adjustment did not quite seem to take fully. Allegedly.
Everyone loves a Morgan. Even me, unless it's broken again.

In case of trouble you could always ask the police to explain the functioning of the radar device. In case they don't know about the Doppler effect, they clearly don't understand what they are doing. In this case take it to court. If all fails, try the principle of relativity. Absolute space does not exist, and all motion is relative Harald

I have never understood people being prosecuted at 33 in a 30 limit, no more than I understand claims of zero tolerance in certain areas (such as North Wales). ACPO publish national guidelines for enforcement/speed awareness and refer to 10%+2 for enforcement and 10%+6 for speed awareness. Fortunately I've never been in the position of needing to test the guidelines, but as the guidelines are public record I would have thought they give enough indication that prosecution should not occur at less than 35 in a 30! http://www.acpo.police.uk/asp/policies/D...e%20Website.pdfI know that there is at least one ex-bobby who visits this site, so maybe he can explain! The same guidelines also state: "These guidelines are for forces to consider. It is permissible to have some minor variation on these guidance notes, as administrative practice will vary from force to force and there is scope for more detailed local arrangements to be made provided the referral criteria, exchange of offenders, use of the database and compliance with the minimum core content of the ANDISP course model are adhered to." My italics... Cheers,

About 2 years ago I was nearly home after work driving through the main road through our village when cop with a radar gun appeared, he asked me what the spped limit there was (30 mph)then turned the gun around to show me the display - 44, my heart sank being convinced I was going to get my first ever points (I'm 54 so must have been born lucky!). He asked if I was going home, I replied yes, he asked where I live and when I told him "at the end of this road" he simply suggested I watch my speed in future and wished me a good evening!!!
A couple of years prior to that I was at the rear of a line of traffic on the A25 doing somewhere between 35 and 40 in a 30 zone. A parked police car pulled out and followed us until he switched on his blue lights and pulled me over. His opening comment was "I know there was a load of you speeding but you were at the back so tough luck!". When I passed a breath test he sent me on my way with no points but it did destroy my theory that they'd always go for the bloke at the front

I'm no lawyer and certainly don't want to start a legal argument, but doesn't the discretion refer to admin? As I said I'm fortunate in that I haven't need to test the application of the guidelines (and with most of us I suspect that it is just good fortune!)
The guidance was updated in April 2010, prior to that one of the footnotes said:
3 ACPO bottom level threshold – ACPO set a limit below which speed offences should not be prosecuted so as to allow for equipment inaccuracy, speedometer inaccuracy and human error interpreting a speed indication by dial. Prosecutions below this level should be undertaken by way of careless driving or other offence, not speed offence alone.
Still puzzled in Stoke!

I think the discretion depends on who is reading the guidelines at the time! But then, I'm just an old cynic Cheers,
