I always thought that the paperwork when ordering an Aero stated that side pipes were not holomogated and were an after-fit but you paid for 'side-exit preparation'.

Maybe that is just in the UK.

I understand you are correct.

Of course, in the UK there is no measured noise check in the MOT, and largely little real control of after market modifications.

Tarka is rated at 87db at 4725 rpm. At Castle Combe circuit they measured 86db at about 4500 rpm. I believe the car has an absolutely standard exhaust.
As there are no silencers after the ones under the running boards below the doors I cannot see that side pipes would make much, if any, more noise.

It may have to do with the regulations as to where the sound is measured.

Perhaps the solution for the test is to simply turn the outlets so they point under the car.... then turn them back.... hide

They seems different. The muffler on the side exhaust is smaller.

Tarka has a single, quite small, polished stainless covered silencer under each running board, with the outlet running to the back, ending in a double outlet. So different again from both the examples in your photos.

Part of the problem may be that what we see externally as a 'silencer' my have a very different construction & baffles/restrictions internally

Some are constructed to be a Silencer, and some are just a Resonator & you can't tell from the nice shiny outer casing
