Is this a legal requirement, or primarily a sensible safety consideration ? I'm sure that the legal position in Europe on this may be more hard-line.

A spare wheel plus luggages will be too heavy for the rear dampers of the plus six .

No obstruction with the MY 2022 layout with the "split L and R" third brake light. They changed that again to the old style single scoped third brake light in MY 2023. That will has to do with legal requirements to sell the cars everywhere. Since my luggage is quite modest in size I 'm feeling save. Otherwise it's to your own judgement to fit a separate third brake as many Morganeers do. I think the change of being fined in the case you don't do that is very small.

I’ve just re-fitted the “Cobra” high level brake light on my new Plus Four. It was taken off by the dealer when fitting a luggage rack. I have a spare wheel and the rack has sidescreen storage so it is higher than the no spare wheel version. Librands version. The high light clears the rack ok. I use a bootbag not a solid suitcase and that sits lower so the light is not obscured. The rear view is also not obstructed. Being thick, strong waterproof material it is also very light. It has straps fitted and I adda couple of simple ratchet straps for added fixing.
The bootbag plus a couple of holdalls behind the seats carry plenty of luggage. We did a 10 day trip last month and went well.
A future consideration is upgrading the stowage space below the rear shelf. It is an optional extra when speccing but at a cost! The panels there look straight forward to modify for easy access after lifting the carpet so the jack, centrelock spanner, hammer, can of goo, spare fuses etc can go in there. I think someone has already done a similar conversion?

Yes, thought of that. We already have the SSL coil over upgrade, so its stiffer on the rear and the shock is adjustable.. I have not yet discussed the extra spare weight with SSL, as I am not 100% sure the wheels will fit within the removeable rear enclosure.
