I have been badly caught out by Richard Thorne who is about to go into liquidation. My Roadster has been for sale with him for 18 months now and he has kept on telling me it just takes time to sell. At the moment the firm are being evasive telling clients their cars have been sold (out of the Blue) but the cars are still advertised for sale. When you ring up the answer is 'the car is not here so it must have sold'. When, how much for and to who is not disclosed and I cannot get an answer. How the mighty have fallen and how dishonest. I now stand to lose the best part of £45K.

Sorry to hear this. do a Tax and MOT check on the vehicle, if the number plate hasn't been changed, it will tell you not only the TAX and MOT status but also notes the last V5 date change.If that date doesn't accord with your latest V5 you may have at least a potential date something was updated on the V5 for example sold. https://vehicleenquiry.service.gov.uk/ConfirmVehicle?locale=en.

If the V5 date is the same and its SORN and not Taxed or MOT'd, there may still be hope is not been sold.

Fingers crossed, not an easy situation having been there myself in the past.

Thanks Julian it was my initial thought. However, this has all been well prepared. Last minute informing the creditors, no cars at the garage, lies about the car being sold when it is still being advertised as for sale, no information from Richard Thorne (we have been told to refer all requests to the liquidators). Silence from the Liquidators of course. I suspect the cars are in his storage facility which is not part of the liquidation.

Do the MOT, VED and V5 date of last change details stack up with your understanding of the vehicles current status?

IN my humble opinion, if you then suspect the car is in his storage facility, make a report to the local Police get a crime incident number and if still insured notify your insurers of the potential theft asap, so not to prejudice any claim through late reporting. Write to the Liquidators about your vehicle, asking as to where is it etc. so that they are also aware of your potential claim against the insolvency.

The Liquidators are funded in the main out of the proceeds of the liquidation, if there are little or no funds the amount of work they undertake most likely may not be too extensive. SO the more information you can give them, eg if V5 has been changed, to help them prove fraudulent intent, the more they are focused and may act in pursuit of any wrongful or fraudulent trading and seeking any director's personal liability to contribute to the liquidation........
