^ Good point. I think because M3W's have already been registered and licensed in TX says a lot about their status. Curious to see how ELIO handles this, if and when they come to market.
From what I've read, Elio is not trying to convince law makers that they are a car, but to allow them the right to drive and ride without a helmet.
I think they've partitioned about half a dozen states so far and some have granted a waiver over their helmet laws simply because in essence they look and perform like a car, not a motorcycle which that particular state claims them to be. And hence should be as safe and a helmet is redundant.
I know in MO I called the State Highway Patrol and they said that if it's enclosed, with steering wheel, with seat belts, with windshield and possibly even wipers, if it has three wheels, IT'S A MOTORCYCLE AND YOU HAVE TO WEAR A HELMET. That of course is still the law here in MO.
I would think that a M3W would be just as safe as say a Miata would be, so they don't require a helmet for a sports car that happens to be a roadster.
TX just has that straddle of the seat that's going to be a tough one to get around.
