We did this conversation several times in the past and...according to Motorizzazione civile and Polizia stradale the italian situation is very particular.
The only similar vehicle is the Ape and the driver doesn't need to use the helmet because it doesn't have a open body but... it doesn't have any other crash structure homologated as a safety cage so...is the 3w an open body ?
Yes ...so use the helmet but...safety belts..another particular situation here

they told me ...art 172 cds it about : L6E, M1, N1, N2, N3 vehicle category
The 3W is homologated as L5E so ...the 172 art does not apply in this case
If you know which italian law made mandatory using the seat belts please tell me the number because you are right ...be safe not sorry but i want to respect the rule in anyway.
