I understand that it's a requirement in France that if a high-level brake light is fitted, then it must be visible - so if the bag is in the way, an alternative must be fitted.
That is my understanding - I have an extra brake light that I fix to the case using the luggage straps and plug in to an extra socket I have fitted to give a visible third brake light.
