I think if you look carefully through my replies you will find the answers to most of the questions you pose- certainly regarding the issues of litigation, why the owner and I decided to seek resolution the way we did etc I gave what I felt was a reasoned and helpful answer to your queries about experience of areas of the law I have to say I find some of your own interpretations of what the law on defamation is to be not in accord with my own but since I'm not seeking advice form you that is a matter of no consequence to me
I really don't think there is any more I wish to add Perhaps we should adopt Gambalunga's suggestion and move this on.
One of the beauties of TM as a site is, as I'm sure you would agree, that we can all have views, air them, agree to differ if necessary and get on with other things. This seems to me to be an instance where that needs to be done. if you disagree, then that is your privilege and I respect that
Anyway, I'm off to bed with my Horlicks so I shall stop there

I find it funny that on one hand you're saying that we all can hold views, air them, agree to differ etc., yet decided that that wasn't the case with the bozo from Gomog threatening you into submission.

I'm off to see a solicitor now seeing the pi$$ taking I've been on the end regarding the baboons arse As my solicitor says who cares whose to blame, just make a claim  . Followed quickly by that will be £500 sir  Gerwyn, does this mean we'll be seeing you in a new car soon? Interesting. My ex associate Jeremy named one of his pubs "The Honest Lawyer" on the basis that it was considerably more far fetched than, for example, a pig that can play the whistle. +1, well said Sir  , could not have put it better myself

Neil The topic remains about a certain used Morgan and the contributors are car lovers. Why close the thread ? As a bonus some lessons have been learned, egos pricked and we've moved on. It appears that the car in question has been painted by Kevin at Tudor Motors. I can say from personal experience that the paint quality is likely to be excellent. Obviously that would only apply at the time of painting .... allegedly .... oh - and other paint-shops are equally as good I'm sure. I thought the topic was new vs second hand and fully sorted. It appears to have gone down a hole. First rule when in a hole throw away the shovel.  So yes my fellow Devonian is right it should be closed.

phew, thank God for that. I'm sure there's probably some merit in your argument and on the other hand I am aware of Gerwyns professional standing and understanding of the law, but the debate is for another time and place. This is/was a personal issue and he has clearly indicated he has no wish to discuss any further.

Rather than closing, let's get back on topic. I must admit I have bought far more used cars than new. This however normally tends to be for fiscal reasons and as such slightly irrelevant for this discussion. As such taking out any financial advantage, and introducing Morgan and their foibles I personally would probably prefer a new car simply for the joy of anticipation. We all know that most of the joy of a new car is the initial thought process, the search and then the excitement leading up to collection  oh of course with our cars the enjoyment doesn't end, far from it, but it's a different enjoyment. The stages are probably more akin to those we go through when meeting our better halves, the thrill of the chase, the twinge of the heart strings when you see a reciprocation and the euphoria of falling head over heels. The period of ownership is then similar to the deep love of a good woman after the initial 'excitement' and adrenalin has worn off. A good solid affection and bond and of knowing you are both meant to be together, fully respecting each others wants and needs. ok ok so I may have gone a tad off topic, and a bit mad  but you know what I mean. and thus, to get back on line, that's why a prolonged buying process would swing me over the 'hassle' of getting those little niggles sorted
