Presume this metal stud issue applies to new generation cars though Perry and is not retrospective to earlier models still in production (e.g. the M3W)? That is correct. No law, yet, is set to encompass things retrospectively. You would shocked to see/hear about what normal manufacturers have to go through to get cars certified. As for the comments about laws being too constrictive, they are here for a reason and let's be honest, it doesn't specially call out 'you can't have a metal stud on top of the dash'. It's more about what comes flying off during a crash and/or what could come into a contact of an airbag or worse yet, your head coming into contact with.

Like all things I suspect it started in the US with Ralf Nader, with his "Unsafe at Any Speed, and may have taken root in the EU, perhaps more so here when we also adopted a litigious culture..?

I'm not so sure I would. It's no surprise that getting a new car to market costs so much in £/$ and time. Trawling through mountains of homologation paperwork is not something I would care to be involved with (though it might help my insomnia!  ).

Safety rulings are for the most part I suspect entirely reasonable and understandable for the average modern car. However with Morgan, the classic old style body shape alone, irrespective of the high tech it's covering, is more than enough to place it in any entirely separate and near unique category. I believe its this fact that is at the crux of matter, placing the need for old style fittings outside the one size fits all rulings.

I read that as "Manufacturers shouldn't be allowed to sell dangerous products unless I don't like the result". The notion that MMC couldn't design an alternative tonneau cover fastening system that fits within legislation is just plain risible. One screamingly obvious possibility is to put the studs on the tonneau cover and have holes in the dash that could have rubber plugs when the cover is not in use. I'm sure a skilled designer could come up with a much better arrangement.

...or just do an aftermarket fit. I would have thought a good trimmer would be able to fit one and once the car is registered there should not be an issue
