I reported on this site back in 20/07/11 of a stress cracked windscreen on my barely year old 4/4 Sport. After much debate, anger, frustration and time spent in regard to the issue, I decided early this year to pursue my complaint against MMC after discovering an interesting point in the EU regulations (regulations that we all sometimes complaint about). The regulation in question is number 861/2007, European Small Claims Procedure. Basically, this regulation provides for the filing of a small claims action (under 2,000 euro) across EU borders without having to appear in person. (I would assume there is a small claims court in the U.K. that could be used by citizens)
I had received two responses from MMC and they refused to do anything about the problem and claimed that the factory warrantee did not cover glass even though it was a stress crack. After that there was a complete stone walling and no response to my further inquiries. I submitted a report from a French auto expert (court approved) stating the crack appeared to be caused by stress in the body structure and not any foreign object and suggested a representative of Morgan discuss the issue with him. There was no response from MMC.
I put together a case referencing the number of reported cases of cracked windscreens on this forum, along with report from the French automotive expert and included photos of newer 4/4 Sports with revised windscreen pillars. Also, I included a screen shot from MMC web site 'car creator' page showing new 4/4 basic models with revised pillars.
After filing the action against MMC (at a costs of 80 euros) and approximately five days before they were required to submit their side of the case, which would be decided by an arbitrator of the court; I received an letter from the solicitor who represented MMC stating that they would like to settle the matter before going before the court. I am not allowed to discuss the settlement as one of the terms of the agreement, but can say an agreement was reached.
My only further comment is, if one feels they have a valid complaint, I feel it should be acted upon.
