And the counter argument is:

Yes, it is an upgrade. But an upgrade to an inadequate design which clearly is so as otherwise, failure would not occur in the guarantee period.

As a result, the upgrade is needed for the product to meet the reasonable expectations part of the sale of goods act.


I'm not a lawyer, but I cannot imagine this argument failing should (which it won't) it be taken to law.
