If you have laser cut pedals to be safe you really need the modification kit. Even if there is a fillet weld there are a lot of torsional forces on the tube and welds between the pedal and the actuator arm. I would not trust it. Better safe than sorry.

+1. Definitely the right way to go, how often is enough to check if the brake pedal weld is still OK? This linkage in unmodified form is not fail safe, the torsion tube is a poor design badly engineered. The addition of a simple, cheap and easy to install modification makes it fail safe and removes the need for regular inspections. It also removes that doubt at the back of your mind, "are the brakes going to fail?????" every time you drive your M3W.
