I am amazed that MMC have not been had up in court over the 3 wheeler. Mine is in the process of being sold, as I do not want the list of inevitable problems to strike when it is out of warranty. I was interested in peoples reaction to this list of faults, that so many of us are suffering from, when I was chatting to various people at the Thrill on the hill event.
It is my opinion that Morgan could be had up on at least 2 things, one being “not fit for purpose” and the other being “not of merchantable quality”.
The problem as I see it is that the contract of sale is with the dealer, who in good faith sold me a car, unaware that this huge list of problems were about to occur. So under UK law one must take the dealer to court, they in turn can drag MMC along with them.
But people are too polite to drag them through the courts. The attitude of “I have a plus 8 as well and it has never put a foot wrong” is not the right one, this car should be built to last, and it is not. Unfortunately the build quality is low and the design has a lot of floors in it that should never have made it through R&D. I was told that people who but the 3 wheeler like to “tinker” with it, this may be true, I have classic cars to “tinker” with, and do not expect to have to do any more than put petrol in a new car, not have to have a load of major, safety critical components wear out in 2000 miles and for Morgan to then have the cheek to tell me that there is a better part now available, you can have it, but only if you pay for it yourself.
As I have already mentioned mine is going soon (I hope) but this will not be an end to the matter as far as I am concerned. If enough owners got together and took legal action, on mass, MMC would have to do something. If this were Toyota, they would be re-calling all the cars that may be affected, as we have seen them do in the past.
This whole situation with the 3 wheeler is not good for anyone involved in it, especially us, the customers. This could, or should even, tarnish, if not ruin Morgan’s reputation.
