Morgan Plus Four Warranty
So far as I am concerned the Warranty position is confused. I refer to my earlier posts in relation to it where I indicated pitfalls.
I have grave doubts that any extension of the warranty period is effective in all individual cases. MMC have just not given proper care and consideration to this aspect of the matter
The Owner’s Handbook
The notes below are based on the Handbook provided when I purchased my CX Plus Four in February 2021. It may be there are different versions this Handbook issued from time to time.
This Handbook is in different terms to that shown in the screenshot above but there are common terms. Everyone should check what their individual Handbook says. Any “new” Handbook terms do not bind me and I am not entitled to the benefit of the same.- I purchased my CX in February 2021
The heading to the relevant part of my Handbook is “Warranty Information” not “Terms of the Warranty” or “Warranty Terms”
The section of my Handbook states that it “explains in detail the warranties that apply …..” .
In other words my Handbook on its face does not purport to set out the terms of the Warranty but purports to explain what they mean.
If the relevant section is intended to set out the terms of the Warranty it is it is appalling badly drafted with obvious spelling errors. Similar criticism may be levelled at the “new” Handbook
If there is somewhere a written form of warranty terms these have never been disclosed or provided to purchasers as I understand it and the handbook explanation may be mistaken as to the effect of those terms. In any event and obviously in such circumstances the undisclosed terms are unlikely to be binding on purchasers.
If there is no such underlying and binding terms (as seems likely) MMC obviously intend as do the purchasers that there should be some form of warranty, The terms of any such warranty will be implied from the explanation given in the Handbook. Given the usual wide terms of warranties recent years this will compound the difficulties for MMC and benefit me and others.
The explanation in my handbook also states that no third party (e.g a Morgan dealer) has authority to alter the terms of the warranty – consequently if a dealer says the warranty is for a period of 30 months or three years in writing or otherwise (indorsed on any invoice) MMC is not legally obliged to honour this.
Under the heading “What is covered under the new vehicle limited warranty” it is stated in my Handbook that “Your warranty covers you for one year or 12000 miles free recovery service ------“. I have not been provided with details of the free recovery service but it appears that the recovery service is separate from the remainder of the warranty provisions and limited to 12 months or the mileage stated but the remainder of the warranty is not and continues (apparently for the lifetime of the vehicle provided the conditions of the warranty are observed eg servicing). An alternative to this is that the warranty continues for 12000 miles (in my case this will be 4 to 5 years provided that the vehicle is annually serviced on the basis of 3K miles p.a.).
I cannot trace any other provision in my Handbook save that above which restricts the time period of any part of the warranty.

I am not concerned to give legal advice and I do not carry insurance. Obviously prior to my retirement I gained considerable experience in litigation. What I do say is that individual purchasers should read for themselves all documents relating to the warranties with great care.
In my respectful view what has happened is that MMC has dug a hole for itself and kept digging instead of being frank and open and set a clear course to keep customers and prospective customers happy. The damage to the marque caused by the recent course of events is incalculable despite I and others being able to say that in other respects the purchase of a CX Morgan has brought much joy, pride and sense of fulfilment.
